Iredell County's New Short-Term Rental Regulations

As of January 1, 2024, property managers and owners of vacation rentals in Iredell County will need to adhere to a new set of regulations outlined in the Iredell County Land Development Code. These regulations are designed to ensure that short-term rentals (STRs) align with zoning guidelines and uphold certain performance requirements.

Understanding Short-Term Rentals: The Iredell County regulations define short-term rentals as primary or accessory dwelling units rented for personal use, vacation, leisure, or recreation purposes for periods of 90 days or less. This includes both whole-house and partial-house rentals. Notably, short-term rentals are allowed in all zoning districts, excluding Industrial (M1 and M2).

 

 

Key Performance Requirements: To operate a short-term rental, property owners must submit a request for a zoning permit in accordance with Chapter 8 of the Ordinance. The application process may involve providing a site plan illustrating compliance with various performance requirements, including deed references, bedroom numbers, signage locations, and adequate parking.

The Zoning Administrator holds the authority to deny or revoke a zoning permit under specific circumstances, such as incomplete or inaccurate information submission or multiple verified zoning violations at the property. If a permit is revoked, a new permit for the same property cannot be approved until one year has passed from the revocation date.

Number Allowed and Maximum Occupancy: Each approved dwelling unit is permitted only one short-term rental. The maximum occupancy is regulated to ensure safety and adherence to local zoning guidelines, with no more than two persons per bedroom, plus two additional persons. The maximum occupancy, based on Iredell County tax records, must be prominently displayed in the rental unit and on all online listings.

Parking and Designated Responsible Party: A minimum of one off-street parking space per bedroom is required, and on-street parking is strictly prohibited. Additionally, all short-term rentals must have a designated responsible party available 24 hours a day to address questions, complaints, or other issues.

Compliance with Noise Regulations, Signage, and Events: Short-term rentals must comply with noise regulations outlined in the Iredell County Code of Ordinances. Advertising the property as a short-term rental is restricted, with limited permissible signage. Large gatherings exceeding occupancy limits, such as weddings or parties, are strictly prohibited.

Effective Date and Application Process: Starting January 1, 2024, it will be a violation of the Iredell County Land Development Code to operate a short-term rental without the issuance of a zoning permit. Property owners can apply for a short-term rental zoning permit through the provided application process.

 

 

Iredell County Short-Term Rental Regulations: The Iredell County short-term rental regulations apply to all properties within Iredell County’s zoning jurisdiction. Any property used as a short-term rental shall apply and obtain a zoning permit and meet all the requirements set forth in the Iredell County Land Development Code.
